Welcome to the Cyclemeter GPS, Runmeter GPS, and Walkmeter GPS applications (“Applications”), owned and operated by Abvio Inc. (“we,” “us,” “our,” or “Abvio” in this Policy). We encourage you to read the full text of this Policy for a detailed understanding of our practices, but the most important things to remember are:
• We ask for, collect, and use your location, determined via GPS in your device, to provide our Applications’ core functionality and offer you reports on your progress.
• Because we log your exercise, we collect information related to your health and use it to deliver our Applications.
• We use third parties to help administer the Applications (e.g., storage and hosting providers), and such parties may have access to data from our applications, but we don’t share your personal information with advertisers.
The Data We Collect and How We Use It
In General. When you use our Applications, we use your device’s location services to determine where you start, where you go, where you finish, and how quickly you progress (a “Workout”). We also provide calendar tracking, a history of your routes, a map of your routes, and summaries of your statistics. These metrics are only available within your application and within our internal system with the exceptions described in the “Sharing” section below – unless and until you choose to “export” or email them or share with others as described below. If you click to email/export, you can send data as attachments or as URLs to download your workout history from your browser.
Biometrics. The Applications will collect information about your physical performance. Depending on the specific Biometrics used, this may include your heart rate, calorie burn, or similar information. The customized interface may also ask for your age, gender, height, or weight to calculate this information. We consider this “personal information” for purposes of the discussion of our practices in this Policy and we store such information on our servers along with other personal information collected through the Applications.
Technical Details. When you choose to share your information on third party platforms as described below in the “Status Updates” section, we collect and use your login information for those platforms in order to post the status updates you request.
Customer Service. In some circumstances, we may use information about you and your device collected through the Applications to design or implement updates or provide you with requested support.
How You Share Your Data
KML, GPX, and CSV Files. Our applications use KML, GPX, and CSV files to support sharing workout data. These files contain geolocation information (i.e., a static map point, a path on a map, etc). KML, GPX, and CSV files can be opened with programs like Google Maps, Google Earth, and spreadsheets by anyone with access to the file or a URL to the file. When using the functions below, please be careful to share these files only with people you trust to use and share them responsibly – they have the potential to show people where you have been or intend to be.
Competitors. We allow you to send your own workout plan, locations, route, and pace (part of a “Workout”) or receive the Workout of one or more competitors. This way, you can race one another and track the other’s progress through a common route. Under the “More” tab, selecting “Competitors” will allow you to create an identity for competition, provide your (or your fake) name and initials, and choose whether to share your workouts using either initials (the default) or your chosen name. Your selection will specify information that you can share other people and which will contain the initials or name that you chose to associate with it. Abvio is not responsible for, and cannot control, what recipients do with the data once they have it, so please share it carefully and only with people you trust.
Status Updates. Within our Application, you can share data about your workout with various platforms such as Facebook, Twitter, dailymile, and others. Abvio is not responsible for, and cannot control, what people using these platforms – or the platforms themselves – do with the data once they have it; please be conscious of who you’re sharing with before sending your location information.
How We Share Your Data
We may share your personal information with third parties in one or more of the following ways:
Service Providers. We use a third party to provide us with hosting services and URL shortening services, so information gathered with our Applications may be stored on servers hosted and controlled by a third party, though we do not expect such third parties to access our content other than for system maintenance purposes.
Safety, Security, and Compliance with Law. We may disclose any information, including personal information, we deem necessary to comply with any applicable law, regulation, legal process or governmental request, to enforce our rights, or to protect the safety and security of our Applications or other users.
How We Secure Your Data
Transmissions to and from our servers are not encrypted. While we take reasonable logistical and technical steps to keep your information secure, no transmission over the Internet or a mobile network can be totally secure, and we cannot guarantee that a breach will never occur.
How You Can Access or Update Your Data
Your California Privacy Rights. We do not share your information with third parties for direct marketing purposes, therefore we are not subject to Cal Civ. Code 1798.80.
